What is Stamp Duty?

Stamp duty in Hong Kong is a tax imposed on certain types of documents, including agreements for the sale of immovable property, for the lease of property and Hong Kong stock transfers. It is governed by the Stamp Duty Ordinance. Please Refer IRD for Details.

Who pay for the Stamp Duty?

Sale of Property:
- Stamp duty for property sales is generally paid by the buyer or transferee of the property.
- The duty is calculated based on the consideration or market value of the property (whichever is higher).
- Rates vary depending on the value of the property and whether it is residential or non-residential.

Leasing of Property:
- Stamp duty for property leasing is typically shared between the landlord and the tenant.
- Both parties are required to pay stamp duty on the lease document.
- The duty is calculated based on the annual rental value or the total rent payable over the lease term (whichever is higher).

Hong Kong Stock Transfer:
- Stamp duty for stock transfers is usually paid by the buyer or transferee of the shares.
- The duty is calculated at a rate of 0.1% of the consideration or the value of the shares transferred (whichever is higher).

On Lease of immovable property:

Stamp duty is determined based on rates that change depending on the duration of the lease. Any fraction of $1 included in the calculated stamp duty should be rounded up to the nearest $1.

On Transfer of Hong Kong Stock:

Any fraction of $1 included in the calculated stamp duty should be rounded up to the nearest $1.

What is the BSD tax in Hong Kong?(This Policy has been withdrawn on 28 Feburary 2024)

BSD - Buyer`s Stamp Duty
Applied to :
-Non Hong Kong Permanent Resident
-Purchase of Property in the name of Company

The BSD applies a uniform rate of 7.5% on either the stated consideration or the market value of the property purchased, whichever is greater. It is an additional duty imposed in addition to the ad valorem stamp duty and the SSD (if applicable), but there are exemptions available in specific circumstances.

What is the SSD in Hong Kong?(This Policy has been withdrawn on 28 Feburary 2024)

SSD - Special Stamp Duty is applied to Residental Property Only with the following rates:

Holding Period The property was obtained between 27 October 2012 and 25 October 2023. The property was obtained on or after 27 October 2012 and sold on or after 25 October 2023.
6 months or less 20% 20%
